These Terms and Conditions govern your use of our website design services, including free and premium website packages, poster design services, and any related services we provide. By using our services, you agree to be bound by these Terms and Conditions. Please read them carefully.

In these Terms and Conditions, the following terms shall have the meanings set forth below:

- "You," "Your," "Client" refers to the individual or business using our services.
- "Free Website" refers to our ad-supported website offering with no upfront cost for the website itself.
- "Premium Website" refers to our R550 paid website offering with no advertisements.
- "Poster Design" refers to our R100 per design graphic design service.
- "Domain" refers to your website address (e.g., yourbusiness.co.za).
- "Services" refers collectively to all website design, development, and design services we provide.
Our Services
Free Websites
We offer free, ad-supported websites that allow you to establish an online presence at no cost for the website itself. To use this service:
- You must provide your own domain name purchased from a domain registrar of your choice.
- Your website will display advertisements served by our advertising partners.
- We reserve the right to determine the placement, type, and content of advertisements displayed.
- You may not remove, block, or interfere with the display of advertisements.
- We reserve the right to discontinue the free website service at any time, with reasonable notice to affected clients.
Premium Websites (R550)
Our premium website service provides an ad-free professional website for a one-time fee of R550. This service includes:
- A custom-designed website without advertisements
- Design consultation to understand your business needs
- Essential pages including home, about, services, and contact
- Mobile-responsive design
- Search engine optimization (SEO) foundations
Premium website clients are responsible for:
- Purchasing and maintaining their own domain name
- Providing all content (text, images, business information) in a timely manner
- Reviewing and approving design drafts within reasonable timeframes
Refund Policy for Premium Websites
We offer a full refund on our R550 premium website within one year of purchase if you are not completely satisfied with the service. To request a refund:
- Contact us via email or through our website
- Provide your order details and reason for refund request
- Refunds will be processed within 14 business days of approval
- Once refund is processed, your website will be taken offline
- You retain ownership of your domain name
Poster Design Services (R100 per design)
We offer poster and flyer design services at R100 per design. This service includes:
- Professional graphic design based on your requirements
- Design that matches your website's branding (for existing clients)
- Print-ready digital files delivered to you
Poster design does not include printing services. You are responsible for taking the design files to a printer of your choice. We do not guarantee the quality of prints produced by third-party printers.
Domain Names
We do not register or manage domain names on your behalf. You are responsible for:
- Purchasing your own domain name from a domain registrar of your choice
- Maintaining your domain registration and renewing it before it expires
- Ensuring your domain's DNS settings are correctly configured to point to your website
- Paying all fees associated with your domain registration
We may provide guidance on domain registration but are not responsible for any issues arising from your domain registration or management.
Client Responsibilities
To ensure timely delivery of your website, you agree to:
- Provide all necessary content (text, images, business information) within a reasonable timeframe
- Review design drafts and provide feedback within 5 business days
- Ensure all information you provide is accurate and complete
- Obtain all necessary permissions for images or content you provide
- Maintain the security of your website login credentials
Delays in providing content or feedback may delay your website launch. We are not liable for delays caused by client inaction.
Intellectual Property
Website Design
Upon full payment for premium websites, you own the design and content of your website. You retain all rights to the text, images, and business information you provide. We retain the right to showcase your website in our portfolio unless you specifically request otherwise.
For free websites, the design remains our property, though you retain ownership of your content and domain name.
Poster Designs
Upon payment for poster design services, you receive a license to use the design for your business purposes. We retain the right to display the design in our portfolio. You may not resell or redistribute the design files to third parties.
Prohibited Use
You may not use our services to create websites or materials that:
- Promote illegal activities or content
- Infringe on the intellectual property rights of others
- Contain defamatory, harassing, or threatening content
- Promote hate speech or discrimination
- Distribute malware or engage in malicious activities
- Violate any applicable laws or regulations
We reserve the right to refuse service or terminate existing services for violations of these prohibitions.
Limitation of Liability
To the maximum extent permitted by law:
- Our services are provided "as is" without warranties of any kind, express or implied.
- We do not guarantee that your website will generate any specific level of traffic, sales, or business results.
- We are not liable for any indirect, incidental, or consequential damages arising from your use of our services.
- Our total liability to you shall not exceed the amount you paid for our services (if any).
- We are not responsible for downtime caused by hosting providers, domain registrars, or other third parties.
- We are not responsible for any loss of data or content after your website is delivered.
Third-Party Services
Your website may integrate with third-party services including but not limited to:
- Google AdSense (for free websites)
- Google Analytics
- Hosting providers
- Domain registrars
These third-party services have their own terms and conditions and privacy policies. We are not responsible for the practices or policies of these third parties. You acknowledge that your use of these services is subject to their respective terms.
Advertising on Free Websites
Free websites display advertisements served by our advertising partners, including Google AdSense. These advertisements:
- Are served based on visitor behavior and preferences
- May include personalized ads based on visitor data
- Generate revenue that supports the free service
You agree not to interfere with the display of advertisements. You acknowledge that we do not control the content of advertisements displayed on your site.
Termination
We reserve the right to terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms and Conditions.
Upon termination:
- Your right to use our services will immediately cease
- For free websites, the site will be taken offline
- For premium websites, refunds will be processed according to our refund policy if applicable
- You remain responsible for any domain name you own
Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. If we make material changes, we will notify you through our website or by email. Your continued use of our services after any changes constitutes acceptance of the new Terms and Conditions.
Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms and Conditions constitute the entire agreement between you and CHF Websites Creators regarding our services and supersede any prior agreements, understandings, or representations.
